A collaborative divorce attorney is a collaborative-trained divorce attorney trained in the collaborative law process. Here, each party would hire his/her own collaborative attorney to represent them. The parties and their attorneys sign a contract, referred to as a “participation agreement,” that states both parties are committed to using cooperative instead of combative tactics to negotiate the issues.
In the collaborative process, a series of meetings take place between both spouses and their collaborative divorce attorneys. If agreement cannot be reached, the collaborative attorneys will be disqualified from representing the parties and the parties will then continue with family law court proceedings (i.e. divorce litigation), using tradtitional divorce attorneys.
